Terms and Conditions
YOGA
If you come to a yoga retreat/class or event whilst pregnant, you are pracising at your own risk. I can advise, modify your poses and teach you but I will not be liable for any complications whilst excercising pregnant.

RETREATS AND EVENTS
The deposit, full payment are non transferable and non refundable.
You must provide details of emergency contacts incase of an emergency.
INSURANCE
You must take out holiday insurance, including cover for surfing, or any other activity you wish to do as you would any other holiday. You must take out your own insurance to be covered. Any other activites, surfing and free time during the retreat is done at your own risk.
Your booking is not confirmed until we receive payment of your deposit. Our trips have limited availability so early booking is advised to avoid disappointment.
You must pay the full balance by the due date set at the time of booking, 10 weeks before the retreat.
We do not accept or assume any responsibility or liability for accidents, injuries or even death occurred while taking part in any trip. You must take out suitable insurance for all your needs before you travel. We cannot be held responsible for any costs you may incur as a result of failing to do so. If you take part in activities whilst on holiday that have been organised and arranged independently of us, participation is at your own risk and it is your responsibility to ensure that you have obtained the relevant insurance.
If I need to cancel the retreat or an event for any reason I will fully refund your deposit/full payment. I am not responsible for any financial lose due to cancellation. No refunds will be issued for non attendance or through cancellation
Please advise me of any medical conditions/injuries/disabilites etc at the time of booking. Please also let me know of any allergies etc. If you become injured before the retreat please advise me asap.

If you choose to share cars with other guests whilst on a trip, We are in no way responsible for any risk, injury or death occurred through car sharing. We are not responsible for how you arrive at the starting point or trip location. We will provide information regarding how to get there, however it is your responsibility to research and make your own travel arrangements.
We may need to reschedule outdoor events due to weather conditions ie surf lessons.
You agree not to hold us responsible or for any inconveniences, financial losses, injury from the Weekend Retreats or Holiday.We strongly recommend you take out comprehensive travel insurance at the time of booking a weekend retreat or holiday.
Some trips will be subject to group size minimum in order to run, and therefore occasionally have to be cancelled if this is the case we will inform you at the time of booking. If in our reasonable opinion your chosen holiday arrangements are not suitable for your medical problem or disability or you are not travelling with someone who can provide all assistance you may reasonably require, we have the right to refuse to accept the booking. If you do not give us full details of your medical problem or disability we can also cancel the booking when we find out full details if in our reasonable opinion, the holiday arrangements are not suitable or you are not travelling with someone who can provide all assistance reasonably required.
If you take part in activities whilst on holiday that have been organised and arranged independently of us, participation is at your own risk and it is your responsibility to ensure that you have obtained the relevant insurance. As part of your booking with us, you are accepting liability for any loss or damage caused by you or any member of your party during the course of your holiday. Payment for any loss or damage must be made to us or our Supplier/Principal at the time that it occurs or as soon as is reasonably practicable thereafter. We can refuse to accept you as a customer or refuse to continue dealing with you and/or any other member of your party by terminating your holiday arrangements if yours or their behaviour is or is likely to be, in our reasonable opinion or in the reasonable opinion of us, disruptive, upsetting or dangerous to yourself or anyone else, or if you or any member of your party have caused or are likely to cause damage to property. In these circumstances, we will not pay any refund, compensation or other sum whatsoever or any costs or expenses incurred by you if we have to terminate your travel arrangements due to such unacceptable behaviour. In this situation we will have no further responsibility for you or any other member of your party (including any return travel arrangements). Your contract will be with the operator or provider of that excursion, tour or activity and not with us. We are not responsible for the provision of the excursion, tour or activity or anything that may happen during the course of its provision by the operator. We do not accept any liability in relation to any such excursion, tour or activity and these Booking Conditions do not apply to them. We are not responsible for your travel arrangements or costs getting to or from events and travelling around at the event.

OTHER
Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”.
Force Majeure means any event beyond our the Supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster.
We cannot be held responsible for the actions or behaviour of other guests on the trip. The person making the booking must be at least 18 years of age and authorised to do so by all persons named in the booking.

PRIVACY POLICY
We respect the privacy of all our members. This privacy policy explains how we use the personal
information we collect when you join as a member and during your membership with us. This privacy policy explains how we comply with the law on data protection and your rights
for the purposes of data protection.
1. The information we collect about you
You may initially provide us with or we may obtain personal information about you including
your:
• personal contact details: name, address, phone number, email address;
• date of birth;
• gender;
• details of next of kin, family members, and emergency contacts;
• event start and end date;
• communication with me regarding; bookings, emails, letters, telephone
conversations, and instructions to us;
• any transactions and billing information via credit or debit cards or by direct debit and
other payment methods, details of which you provide so that we can receive payments
from you;
• images in video or photographs;
• records of your class types attended and any events presented by us;
• your marketing preferences from surveys so that we know when and how to contact you;

Sensitive personal information
We may also hold sensitive personal information in relation to your health and any notified
medical condition to include medical records and health information.
This information will only be held with your explicit consent.
3. How we collect information from you
We collect personal information about you when you come to an event or retreat. If you list emergency contact details such as friends or family
members, they should also be made aware of our privacy policy and the information we
maintain. If you are purchasing any training or programmes from us, this information will be
included in your personal data.
4. How is your information used?
We may use your information to:
• manage the type of contract you have with us using your contact details
and dealing with payments and any enquiries;
• monitor attendance of classes and programmes purchased;
• notify you of changes to our amenities and programmes;
• provide you with information about your any programmes or
classes that you have requested and that may be of interest;
• send you other marketing information we think you might find useful or which you
have requested from us, including our promotions, events, newsletters and
membership guides. We will only do this where we have your explicit consent;
• respond to your queries and any observations.
5. Marketing
We would like to send you information from time to time about events that may be of interest
to you. We will only contact you in accordance with the marketing preferences you have
indicated to us. You have a right at any time to stop us contacting you for marketing purposes.

Please note that if you withdraw your consent this will not affect any use of the data made
prior to this date. Please also be aware that the lack or withdrawal of consent may affect the
services provided at the time of withdrawal. If you have any queries, please contact the staff at
Neo Spirit Yoga. I may take photographs on the retreats, events and classes for my social media. If you see something you want me to take down please let me know.
6. Access and update of your data
Your personal data will be treated as strictly confidential. We will not share or divulge your
information to third parties for any marketing purposes unless you have requested us to do so.
We will only share personal information with our trainers and employees to fulfill your
agreement with us. We may also be required by law or regulations to comply with
any investigation and share information.
Only the personal information that is required to deliver the service to you is disclosed to a third
party. When you are using our online payment system, the payment is processed by a specialist
in the area of online security of credit and debit transactions who only receives the details
necessary to process the transaction. No other personal data is available to the payment processor
without consent.
You have the right to request a copy of the information held by Neo Spirit Yoga about you.
You also have the right to request that personal information is amended or deleted if inaccurate. It
is important that the details we hold are accurate and up to date and if any of your details change
such as address, email, phone number, please contact us kirsty@neospirityoga.com. If you
believe that any information we are holding on you is incorrect or incomplete, you can also contact
us We will promptly correct
any information found to be incorrect.
8. Changes to our privacy policy
We regularly review this privacy policy and may update it from time to time. If necessary, we
will contact you to seek your consent when required by law.
